How To Do Probate Without An Attorney

We will give you two sets of instructions:

  • for when there is a will

(You should probate the will in solemn form.)

Probating A Will Without A Lawyer

When there is a will, the estate gets split up per the will.

The courts will:

  • give beneficiaries the ability to contest the will

Here are the steps the executor needs to take:

  1. Get the Death Certificate: Get 5+ copies of the Death Certificate
  2. Find the Will: Find the deceased’s will and related documents.
  3. File the Petition: Submit the will and file the Probate Petition.
  4. Appoint an Executor: Get Letters of Testamentary from the court.
  5. Notify Creditors and Heirs: Inform all creditors and beneficiaries of the probate process.
  6. Inventory the Estate: List all assets, including property and accounts.
  7. Appraise the Assets: Determine asset values, often with professional help.
  8. Settle Debts and Taxes: Pay off all debts and taxes owed by the estate.
  9. Distribute the Remaining Assets: Allocate assets to beneficiaries as specified in the will.
  10. Close the Estate: File a final accounting with the court and request estate closure.
